Administering a probate estate is a public process. A personal representative must prepare and file an inventory and before any assets can be distributed must file a petition accounting for these assets and asking permission to distribute them. Since this process can take time, sometimes this delay appears to be secretiveness.
On the other hand, a trust is a private agreement and thus there is no automatic right to informed of the trustee’s actions. Disclosure of information to the heirs and beneficiaries is going to depend, in part, on the instructions given to the successor trustee in the trust.
No matter what type of plan exists, sometimes people use fiduciary positions to their advantage. Interested parties can take a number of steps to force disclosure if it is warranted.
