Many beneficiaries are surprised to learn that they do not have the right to inherit from their loved ones. One exception to this rule is the omitted spouse of a loved one but, in some circumstances, the spouse can also be excluded from an estate plan. A challenge to an estate plan is considered a disfavored action in California and generally you are not entitled to jury trial.

A common form of elder abuse is forcing an elderly person to change an estate plan. We have successfully resolved numerous cases where estate plans have been changed under suspicious circumstances.
