Frequently, we are called upon to deal with situations where family members have included others on assets without considering the potential ramifications of their actions. A few examples are illustrated below.
An elderly woman was found emaciated in her home suffering from dementia.  A daughter moved into grandmother’s home and influenced her to transfer a 50% interest in her home.  After a conservator is appointed, the daughter refuses to surrender her 50% interest to pay for the mother’s care.  Our firm successfully voided the grant deed.
A granddaughter discovers that grandmother’s home is in foreclosure, although her grandmother had not been making loan payments for years.  An investigation reveals that a stranger has taken a 50% interest in grandmother’s home and borrowed money against it.  After suing for elder abuse, our firm is able to obtain a sizable recovery for the grandmother’s estate.
An elderly mother added her son to title to her home.  When the mother later needed money to pay for dementia care, the child refused to allow her to sell the home, claiming that his mother wanted him to inherit the house after her death.  Our firm was able to void the partnership agreement and force the son to release her interest in the property to pay for mother’s dementia care.
