Unfortunately, fiduciary theft is not unusual. Often the only remedy is usually to seek intervention of the probate court, which has the power to order the fiduciary to account for his use of assets. The probate court also has the power to remove the fiduciary from his position, order the fiduciary to return missing assets, and even assess punitive damages for mismanagement. If the abuse occurs in the context of a conservatorship, the probate court frequently has access to a bond to cover some or all of the losses caused by the fiduciary.
