Sometimes future abuse can be stopped by simply changing the living situation of the victim. A good estate plan can also be used to limit problems when the victim is willing to surrender control to a trusted loved one. Private management and monitoring of a loved one is almost always preferable to intervention by a governmental authority or the judicial system.
Generally, the most powerful solution to stop future abuse is to create a conservatorship, which vests all legal authority over the victim’s assets in the name of the conservator. As a result, asset transfers made by the victim are generally no longer valid and can be more easily recovered. While a conservatorship is a drastic and expensive remedy, it is sometimes the only solution.
